A constitutional challenge is filed against the “Organic Law on Labor Justice.”
On Thursday, May 7, 2015, at the building of the Constitutional Court of Ecuador, several assembly members from the opposition blocs Cambio, Madera de Guerrero, and independent legislators filed a constitutional challenge against the controversial “Organic Law on Labor Justice,” enacted by the National Assembly through its government-aligned bloc.
The claim challenged Articles 63, 64, and 65 of the Law on procedural grounds, and Articles 15, regarding the limit on profit-sharing distribution, and 68.1, regarding the financing of Social Security pensions, on substantive grounds.
The Court is expected to call a public hearing in which the legal grounds of the filing will be presented and other actors who also filed claims against the Law will be heard.
Our firm’s attorney, Esteban Torres Cobo, acted as counsel for this constitutional challenge.
